Introduction
Taking into account the legal obligation resulting from the provisions of the Act of May 13, 2016 on preventing threats of sexual crime and protecting minors, as well as the content of the guidelines of the United Nations regarding business and human rights, recognizing the significant role of business in ensuring respect for children's rights, Lambert Travel Group Sp. z o.o. adopts the Standards for the Protection of Minors (also “SPM”, “Standards”). This document is a collection of principles and procedures applied in case of suspicion that a child staying in the facilities of Lambert Travel Group Sp. z o.o. is at risk, and for preventing such threats, considering the situation of disabled children and children with special educational needs. The Standards for the Protection of Minors in the facilities of Lambert Travel Group Sp. z o.o. are implemented based on the principles outlined below:
1. Lambert Travel Group Sp. z o.o. conducts its operational activities with respect for the rights of children as particularly vulnerable individuals to harm.
2. Lambert Travel Group Sp. z o.o. recognizes its role in conducting socially responsible business and promoting desirable social attitudes.
3. Lambert Travel Group Sp. z o.o. particularly emphasizes the importance of the legal and social obligation to notify law enforcement authorities of any suspicion of a crime against children and is committed to training its employees in this regard.
Glossary:
For the purposes of this document, the meanings of the following terms have been specified:
1. Child/minor - for the purposes of these standards, a child is defined as any person who has not reached the age of 18.
2. Child's guardian - the legal representative of the child: parent or guardian; foster parent.
3. Adult stranger - any person over 18 who is not the child's parent or legal guardian.
4. Child abuse - to be understood as behavior that may constitute a criminal act against the child by any person, including an employee of the entity, or pose a threat to the child's welfare, including neglect; any intentional or unintentional action/omission by an individual, institution, and any result of such action or inaction that infringes upon the rights, freedoms, and personal welfare of children and/or disrupts their optimal development. 5. Forms of violence against the child:
● Physical violence
● Psychological violence
● Sexual exploitation of the child
● Neglect of the child
6. Crime against a child - all crimes that can be committed against adults, and additionally crimes that can only be committed against children (e.g. Sexual exploitation under Article 200 of the Penal Code).
CHAPTER I. EMPLOYEES OF THE FACILITY
General rules
1. Every employee, before being allowed to work, is acquainted with the SPM, which is confirmed by them by submitting a declaration and a commitment to comply with the principles and procedures contained in this document.
2. Employees employed to work with children are subject to periodic training, which is documented by the employer.
3. Lambert Travel Group Sp. z o.o. is committed to considering the situations of children with disabilities and children with special educational needs.
Employment of individuals to work with children
1. Individuals working with children are strictly verified in accordance with the Act of May 13, 2016 on preventing threats of sexual crime and protecting minors.
Scope of competencies and responsibilities of individuals designated to implement the Standards for the Protection of Minors
- The entrepreneur supervises the application of the SPM.
- The entrepreneur appoints coordinators for the SPM (hereinafter referred to as “Coordinators”: organizational, operational, and HR and payroll specialist in terms of the criminal record of individuals assigned to work with children).

Principles of safe employee-child relationships
1. The primary principle of all actions undertaken by employees having contact with children present on the premises of Lambert Travel Group Sp. z o.o. is to treat the child with respect and take into account their dignity and needs. 2. It is unacceptable for employees and other adults to use violence in any form against a child.
3. Any contact between an employee and a minor present in the facility should not exceed interactions justified by the official duties of the employee of the facility.
CHAPTER II. PROCEDURE FOR IDENTIFYING A CHILD DURING CHECK-IN AT THE RECEPTION
1. One form of effectively preventing the abuse of children is establishing the identity of the child staying in the facility and their relationship to the adult with whom they are staying in the facility.
2. The reception staff will take all possible steps to identify the child and their relationship with the adult accompanying the child.
3. To identify the child and their relationship with the adult they are staying with in the facility, it is necessary to:
a. request the child's identity document or another document confirming that the adult has the right to care for the child. Examples of documents that may serve for identification include: ID card, school ID, MObywatel app, Internet Patient Account, court ruling. In the absence of an identity document or refusal to present it, the staff should request the child's details (name, surname, address, PESEL number).
b. In the absence of documents indicating the kinship of the child and the adult or refusal to present them, the adult and the child should be asked about this relationship.
c. If the adult is not the parent or legal guardian of the child, they should be asked to present a document, e.g. a notarized consent from the parent for this person to travel with the child or a consent signed by the child's parent along with the child's details, their address, contact number of the parent, and the ID document number/PESEL number of the person to whom the parent entrusted the care of the child. If the adult does not possess any of the aforementioned documents, they should be asked to complete an appropriate declaration, according to a template prepared by the facility. The declaration should include the child's details and the details of the adult with whom the child is staying, along with an indication of the relationship between the child and the adult. In the event that the adult is neither the parent nor the legal guardian of the child, they should declare that the parents/legal guardians have given consent for the care of the child.
4. In the case of refusal by the adult to present the child's document and/or clarify their relationship, it should be explained that the procedure serves to ensure the safety of children using the facilities of Lambert Travel Group Sp. z o.o. and that according to the provisions of the Act of May 13, 2016, employees of the facility must comply with regulations concerning child rights.
5. If the conversation does not dispel doubts regarding suspicion towards the adult and their intentions to harm the child, especially if they refuse to present an identity document or the child does not have such a document, and also refuses to submit a written declaration, this should be discreetly reported to the supervisor. The minor and the adult should remain under the observation of the facility's staff during this time.
6. The supervisor, who has been informed of the situation, takes over the conversation with the adult. If the conversation confirms the suspicion of an attempt or commission of a crime against the child, the police should be notified.
CHAPTER III. PROCEDURE IN CASE OF CIRCUMSTANCES INDICATING CHILD ABUSE BY AN ADULT
1. A reasonable suspicion of child abuse occurs when:
a. the child has revealed to the facility staff that they are being harmed,
b. the staff has observed abuse,
c. the child bears signs of being harmed or their behavior indicates that they are being harmed.
2. An employee who has a reasonable suspicion that a child staying in the facility is or has been harmed is obliged to take appropriate actions as a reaction to the above. They should promptly notify their superior/decision-maker, who will inform the police. In the case of an existing threat to the child's safety, the employee who has a reasonable suspicion of child abuse should immediately notify the police.
3. Efforts should be made to hinder or even prevent the child and the person suspected of harming the child from leaving the facility.
4. In the case described in the Code of Criminal Procedure, a citizen's arrest of the suspected person may be made. In such a situation, until the police arrive, the detained person remains under the supervision of security staff or other hotel employees, who can perform such actions without endangering their health or life.
5. After the child is taken over by the police, secure monitoring material and other relevant evidence (e.g. documents) concerning the incident and hand them over to the operational coordinator, who will provide their copy to the prosecutor or police by registered letter or in person upon request from the authorities. The organizational coordinator will document such an incident in the event log.
CHAPTER IV. PROCEDURE IN CASE OF SUSPICION OR DETERMINATION OF CHILD ABUSE BY AN EMPLOYEE OR OTHER ADULT
1. In the case of suspicion of child abuse by an employee or another adult who is not directly employed by Lambert Travel Group Sp. z o.o. but by a third party, the person who received this information should immediately notify the operational and organizational coordinators about it.
2. If the life or health of the child is at risk, the person who received this information should promptly notify the police by calling the emergency number 112, providing their details, the child's details (if possible), the child's whereabouts, and a description of the circumstances, and notify the superior/decision-maker, who will inform the child's guardians/parents.
CHAPTER V. PROCEDURE IN CASE OF DETERMINATION OF OTHER FORMS OF VIOLENCE AGAINST THE CHILD BY THE PARENT/LEGAL GUARDIAN OR OTHER ADULT
1. In the case of determination of child abuse by a parent/legal guardian or another adult with whom the child is staying in the facility, any employee witnessing such abuse should respond firmly to it.
2. If the life or health of the child is at risk, the person who received this information should promptly notify the police by calling the emergency number 112, providing their details, the child's details (if possible).
3. If a facility employee witnesses physical violence directed at the child (spanking, pulling, shouting, other acts as described in the definition of physical violence), they should attempt to interrupt the abuse and take action.
4. In the situation of leaving a child under 7 years old unattended, the employee who received information about such an event should notify their superior. Depending on the situation, the superior attempts to find the parent/legal guardian or another adult with whom the child is staying in the facility. If that person does not want and/or is unable to take care of the child, the superior should notify the police. In every case, the child's safety should be ensured.
CHAPTER VI: MONITORING AND EVALUATION OF STANDARDS FOR THE PROTECTION OF MINORS
1. Monitoring and evaluation, at least once every two years, include verifying the implementation of the Standards, responding to signals of violation of principles and procedures, and proposing changes to the document, especially in terms of adapting them to current needs and ensuring compliance with applicable regulations.
Final provisions
1. The Standards for the Protection of Minors enter into force on August 15, 2024.
2. The Standards for the Protection of Minors are made available to all employees by placing them on the website and at the receptions of facilities of Lambert Travel Group Sp. z o.o..
3. The Standards for the Protection of Minors are made available to guests by placing them on the website and at the receptions of facilities of Lambert Travel Group Sp. z o.o..
4. The Standards for the Protection of Minors are made available in a comprehensible and abridged version for children staying in the facilities of Lambert Travel Group Sp. z o.o. in a location accessible to them.
